Privacy Statement

In the regular course of business, Gilead Sciences Canada, Inc., (hereinafter referred to as “Gilead”) interacts and communicates directly with health care professionals, customers, employees, clinical trial participants, consumers, business partners, regulatory authorities, and others. Through these interactions and communications, Personal Information may be provided to Gilead and processed electronically and/or manually. Gilead respects individual privacy and values the confidence of such individuals. This privacy statement (the “Privacy Statement”) sets forth Gilead’s privacy principles and obligations with respect to Personal Information, including the implementation of privacy procedures and technical security measures to keep Personal Information private and secure. Gilead will collect, use and disclose Personal Information in accordance with this Privacy Statement and applicable privacy or data protection laws.

Scope

This Privacy Statement applies to all Personal Information received by Gilead (including Personal Information received by Service Providers acting on behalf of Gilead) as part of this Gilead Website.

Definitions

For the purposes of this Privacy Statement, the following definitions shall apply:

Gilead” means Gilead Sciences Canada., Inc., its successors and wholly owned subsidiaries.

Gilead Website(s)” means websites controlled by Gilead.

Personal Information” means any information, or set of information, that identifies or is used by or on behalf of Gilead to identify an individual. Examples of Personal Information include an individual’s name, postal address, e-mail address, and telephone number. Personal Information does not include (i) any information that is anonymized, or non-personal information that has not been combined with Personal Information to allow identification of an individual or (ii) an individual's name, business title or business address and business telephone number in his/her capacity as an employee of an organization.

Service Provider” means any third party that collects and/or uses Personal Information under the instruction of, and solely for, Gilead or to which Gilead discloses Personal Information for use on Gilead’s behalf.

Privacy Principles

NOTICE: The collection, processing, storage, use, and disclosure of Personal Information in the business context is essential to the conduct of many of Gilead’s business functions. Gilead may collect, process, store, use, and disclose Personal Information from individuals directly and/or, where Gilead has obtained the individuals’ consent to do so or as otherwise required or permitted by law, from third parties.

CONSENT: Gilead collects, uses and discloses your Personal Information in its normal course of business for the following purposes:

  • Establishing and maintaining communications with you;
  • Disease management, education, or decision support systems related to the use of Gilead products or services;
  • Where you have requested a service from Gilead, assisting you in the completion of your application, the assessment of your eligibility for any such requested service, the processing and maintenance of the service, as well as any applicable renewal of such service;
  • Responding to your inquiries about applications, trials and other services;
  • Making proposals for future service needs;
  • If you have given us your permission, allowing us to notify you of certain products or services offered;
  • Processing transactions through Service Providers;
  • Meeting legal, security, processing, and regulatory requirements;
  • Protecting against fraud, suspicious or other illegal activities;
  • To generate data in a non-identifiable form (anonymized data) in order to compile statistics for analysis of Gilead Websites and our business; and
  • As otherwise permitted by law.

To the extent permitted by law, Gilead may be prevented from providing certain services to individuals who do not consent to the use, access or disclosure of their Personal Information.

Gilead may share, subject to applicable laws and regulations, Personal Information with Service Providers who assist Gilead with its business activities related to the purposes for which the information was collected. Such Service Providers may include, but are not limited to, Service Providers that administer Gilead’s email subscriptions and requests for information, or provide services, including website-related services. Gilead requires such Service Providers to keep Personal Information confidential and to use or disclose Personal Information only to perform functions for Gilead and in accordance with this Privacy Statement and applicable privacy or data protection laws. Because a number of the Service Providers we use are located outside of Canada (including in the United States), your Personal Information will be processed and stored outside of Canada, where they are subject to the laws of the country in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country.

Gilead reserves the right to disclose Personal Information to, in accordance with applicable law, respond to authorized information requests from government authorities or when otherwise required or permitted by law and/or to comply with a judicial proceeding, court order, or legal process.

Gilead may also use and/or disclose Personal Information, in accordance with applicable law, in connection with a contemplated or actual reorganization of its business, when seeking financing or in connection with an assignment, sale, or other transaction involving the disposal of all or part of its business or assets, including for the purpose of permitting the parties to conduct due diligence so as to determine whether a transaction should proceed and on completion of the transaction. In any assignment or sale, the assignee or purchaser may use and/or disclose Personal Information collected by Gilead for substantially the same purposes as described in this Privacy Statement.

We will not share your Personal Information with third parties except as otherwise stated in this Privacy Statement, as otherwise required or permitted by law, or authorized by you.

ACCESS AND CORRECTION: Access to Personal Information is limited to a restricted number of Gilead’s employees with a business ‘need-to-know’ or whose duties reasonably require such information, and, to the extent applicable, certain companies with which Gilead may conduct joint programs. Gilead identifies to whom, and for what purposes, it discloses Personal Information, at the time it collects such information from the individual and obtains the individual’s consent to such disclosure, subject to applicable law. Gilead trains its employees about the importance of privacy and how to handle and manage Personal Information appropriately and securely. Personal Information handled by Gilead Service Providers or companies with which Gilead may conduct joint programs is governed by this Privacy Statement and applicable privacy or data protection laws.

Upon written request, Gilead will, to the extent required by applicable law, grant individuals access to Personal Information that it holds about them. In addition, Gilead will, to the extent required by applicable law, permit individuals to correct, amend, or delete information that is demonstrated to be inaccurate or incomplete, subject to certain exceptions.

Individuals may revoke (opt-out) at any time, to the extent permitted by applicable law, their consent and/or authorization to use and/or share their Personal Information. All requests to revoke or amend consent should be in writing to Gilead as directed below under DISPUTE RESOLUTION.

SECURITY: Gilead will take precautions in accordance with applicable law to protect Personal Information in its possession from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

ENFORCEMENT: Gilead will conduct periodic compliance audits of its relevant privacy practices to verify adherence to this Privacy Statement.

All communications to Gilead should include the individual’s name and contact information (such as e-mail address, phone number, or mailing address), and a detailed explanation of the request. E-mail requests to delete, amend, or correct Personal Information should include “Deletion Request” or “Amendment/Correction Request”, as applicable, in the subject line of the e-mail. Gilead will, subject to applicable law, endeavor to respond to all reasonable requests in a timely manner.

Gilead will investigate and attempt to resolve complaints and disputes regarding use and disclosure of Personal Information in accordance with the principles contained in this Privacy Statement.

Limitation on Application of Principles

Adherence by Gilead to these principles may be to the extent expressly required by a legal obligation or an applicable law, regulation, or rule.
